Spain Investigates Airbnb Over Unregulated Rental Offers

Spain has launched an investigation into the popular home-sharing platform Airbnb for failing to remove thousands of rental listings. This move is part of an effort to regulate a business accused of exacerbating housing shortages and driving up real estate prices in the country.

The investigation was previously announced by the Spanish Ministry of Consumer Affairs, although Airbnb was not named directly. However, the company confirmed on Wednesday that it is the target of the inquiry. Airbnb stated that it would appeal if found to have violated regulations.

This investigation is part of a broader struggle against vacation rentals facilitated by platforms like Airbnb and Booking.com in Spain. Many Spanish citizens argue that these platforms contribute to over-tourism, reduce housing availability, and drive rental prices to unaffordable levels for local residents.

According to a ministry spokesperson, a department within the Ministry of Consumer Affairs has ordered Airbnb to remove thousands of listings classified as "illegal advertising" due to the lack of tourism use licenses since the summer.

A disciplinary process has been initiated following Airbnb's failure to remove these listings. The platform now faces potential fines of up to €100,000 (approximately $104,940.00) or penalties equivalent to four to six times the profits derived from these practices, according to the ministry's statement.

If a monetary penalty is imposed by the ministry, Airbnb has the option to appeal it in court.
